Since leaving the EU, the United Kingdom is a standalone jurisdiction that must be filed separately from the EUIPO — a change that reshaped filing strategy and made UK counsel independently necessary for brand owners who previously relied on EU-wide coverage. Filings are handled by the UK Intellectual Property Office (UKIPO). Foreign counsel instruct UK attorneys for national trademark, design, and patent work and for enforcement before UK courts.

The critical point for foreign counsel is that an EU trademark or design no longer covers the UK. Protection now requires a separate UK national registration via UKIPO, or a Madrid designation of the UK specifically. Brand owners refreshing portfolios post-Brexit frequently need UK filings they did not previously require, and UK counsel are essential to manage this separated layer.

Trademark protection runs nationally through UKIPO or via a Madrid UK designation. Patents run through UKIPO nationally, through the EPO with UK validation (the UK remains an EPO member despite leaving the EU), and through the PCT national phase. Note the distinction foreign counsel sometimes miss: the UK left the EU but remains part of the European Patent Convention, so EPO-route patents still reach the UK on validation.

Proceedings are in English, which lowers the coordination burden for many foreign firms, but UK-specific practice — particularly in oppositions and enforcement — makes local counsel valuable.
