China is indispensable for virtually every international brand and technology owner, both as a manufacturing base and as a first-order market, and it operates on principles that differ significantly from Western systems. The defining point for foreign counsel is that China is a strict first-to-file jurisdiction with no meaningful use-based rights for unregistered marks. A local agent is required for foreign applicants — foreign entities cannot file directly and must appoint a CNIPA-recognized agency.
